How does civil mediation and commercial mediation work?
Civil & Commercial mediators can work on a wide variety of cases including, but not limited to, business disputes as well as those relating to property, inheritance, contract and non-matrimonial co-ownership.
Participation in mediation is voluntary and the process is private and confidential, it brings structure that ordinary negotiation lacks. Unlike in court, where the process is governed by the court’s rules and a judge makes an ultimate decision, in mediation the parties can decide how they want to resolve the dispute and neither party has to accept an outcome they are unhappy with. Mediation allows the parties to stay in control.
Mediation can be an attractive alternative to drawn out litigation, whilst reducing your legal costs and the stress associated with taking a dispute to trial. Mediation is confidential. Disputes that are taken to court can become very public. A mediation is private between the parties involved.
